Aggravated Driving While Intoxicated Arrest, Interstate 93, Holderness, NH

On November 1, 2019, at 11:58p.m., Trooper Derek Newcomb of the New Hampshire State Police-Troop F, was working a grant-funded Driving While Intoxicated Patrol funded by the New Hampshire Office of Highway Safety. Trooper Newcomb was monitoring vehicle traffic on Interstate 93 in the town of Holderness. Trooper Newcomb observed a vehicle traveling southbound at a high rate of speed and obtained a RADAR reading of 101MPH on the vehicle. Trooper Newcomb subsequently pulled out from his location to stop the vehicle for the traffic violation. Once behind the vehicle, it appeared that the vehicle had increased its speed and Trooper Newcomb was able to get an additional reading of 115MPH. Before Trooper Newcomb was able to get the vehicle stopped, it appeared as though the suspect vehicle was going to try to pass between two vehicles that were traveling in front of it. He conducted a motor vehicle stop and identified the operator by his New Hampshire Driver's License as;

DIAZ submitted to a battery of Standardized Field Sobriety Tests and Trooper Newcomb formed the opinion that DIAZ was impaired and subsequently placed DIAZ under arrest for Aggravated Driving While Intoxicated. Trooper Newcomb learned that DIAZ had a prior conviction for Driving While Intoxicated on September 11, 2018. DIAZ was released on Personal Recognizance Bail and ordered to appear in the 2nd Circuit-District Division-Plymouth Court on November 12, 2019 to answer to the above charges.
