Commercial Motor Vehicle Driver Arrested, Route 104, Bristol NH

On September 5, 2019, at approximately 1200, Trooper Kevin Raymond, of New Hampshire State Police, Troop G, pulled over a 2017 Ram one ton truck, pulling a 2018 Kaufman car hauler trailer, for a Motor Carrier Safety Inspection, on Route 104, in Bristol New Hampshire. Trooper Raymond found the driver of the commercial motor vehicle, Mohammed M. Swaray, age 38, of Brooklyn Park Minnesota, to be in violation of a number of state and federal motor carrier laws and regulations.

As a driver Swaray was found to be in violation of the following driver violations, each one, placing him out-of-service as a driver:

  • Operating a Commercial Motor Vehicle Without a CDL
  • Driving a CMV With No Proof a Medical Certification (2nd or more offense)
  • False Reporting of Hours of Service
  • The car trailer he was pulling was found to have the following violations, each one, placing it out-of-service:
  • No working brakes on the trailer, all were defective or inoperative
  • Having a broken and exposed hub
  • Improper/defective trailer breakaway device

Other violations such as the truck not being registered, the company failing to pay Unified Carrier Registrations, the trailer being uninspected, failing to display the proper company name and USDOT number on the truck, and several Electronic Logging Device violations were also found.

Swaray was also found to be in violation of New Hampshire State Law, Disqualification and Out-of-Service Orders, in that, back on August 14, 2019, both Swaray the trailer were placed out-of-service by The Minnesota State Patrol for all of the same out-of-service violations Trooper Raymond had found on his stop.

Swaray was arrested and released on Personal Recognizance Bail. He was given an arraignment date of November 25, 2019, at 8:00 am, at the Plymouth District Court.

Swaray was placed out-of-service by Trooper Raymond for a minimum of 10 hours for the false record of duty status and was also ordered not to drive a commercial motor vehicle until he had the proper license and medical certifications as required.

The truck and trailer were towed from the scene and the trailer was placed out-of-service until the braking systems and broken hub are both repaired.
