Although the NHDOT handles many requests from utility companies, none have generated more attention than the Northern Pass Transmission (NPT) project.

This webpage was developed to explain the NHDOT's role in relation to a utility's (gas, water, sewer, electricity, and telecomm) request to use a State asset (bridge, rail bed, road or highway right of way), and to provide detailed information about the requests submitted by NPT.

DOT's Role

Per State Statute the DOT has a dual role in applications submitted to the Site Evaluation Committee (SEC). The first is as a member of the committee to decide whether or not a new energy facility will be permitted. The second role is as a state agency that has permitting or other regulatory authority but only as it relates to the proposed project and impacts to transportation assets. These two roles are completely separate and must be kept completely separate. Therefore, the DOT member of the committee is not part of the staff reviewing the application for compliance with DOT rules and regulations. The staff conducting those reviews evaluate the proposal like any other utility that may impact transportation facilities. They do not evaluate the merits of the project – that is up to the SEC.

Answers to Frequently Asked Questions

  • Does the NHDOT approve water, gas, or electricity projects?
    • NO - The NHDOT approves applications for access or use of State Assets (State Roads, Bridges, Right of Way areas), for driveways, excavation (for maintenance or exploration) and poles. Learn more about these applications.
  • Will the NHDOT approve the NPT?
    • NO - The NHDOT does not decide if a facility will be built. The NHDOT does decide how it will be built in and around the NH transportation network if the project is approved by the SEC.
  • Is the Commissioner of the Transportation Department a Member of the NH Site Evaluation Committee (SEC)?
    • YES - The commissioner is a member of the site evaluation committee which was established by state statutes (RSA 162-H). The committee is the body that will determine if an energy facility will be permitted. In order to maintain the separation of the two roles Commissioner Sheehan has delegated the responsibility for this project to Assistant Director of Project Development William Oldenburg. The Commissioner is not involved in the NPT subcommittee deliberations.

Applications to access or use State Roads, Bridges, Right of Way Areas

Driveway Permits - Residents and utilities often apply for access (a driveway) on State roads. These applications are evaluated and approved by the District Engineers.

Excavation Permits - Utilities that want or need to install gas, water, sewer or electric facilities need to apply for an excavation permit. These applications are evaluated and approved by the District Engineers.

Encroachment Permits are permits that are identical to the Excavation Permits except that they are issued by the NHDOT Turnpikes Bureau.
