In a petition dated May 5, 2018, and approved for a hearing at the Governor and Council meeting on December 5, 2018, Joseph J. Barton requested a pardon for his 2017 conviction for RSA 642:2 Resisting Arrest or Detention. The power to pardon persons convicted of criminal offenses is vested in the Governor and Council by the Constitution. NH Const., Pt. 2, Art. 52. This constitutional provision is implemented through RSA 4:21-27.

A hearing has been scheduled for Monday, December 10, 2018 at 2:00 p.m. in the Executive Council Chambers at the State House in Concord, New Hampshire. The hearing is scheduled for two hours. The Governor and Council are not bound by the statutory or common law rules of evidence, but may admit all testimony having reasonable probative value. Evidence that is immaterial, irrelevant or unduly repetitious may be excluded.

Under RSA 4:21, a representative of the Newmarket Police Department may be required to provide a concise statement of the case that supported the guilty conviction and any other facts bearing on the propriety of granting the petition. The Governor will determine the witnesses to be called and the order in which they will be asked to provide testimony.

The petition dated May 5, 2018 is part of the record in this proceeding. An original and eight copies of all other documents intended to become part of the record in this proceeding must be provided to John Formella by 10:00 a.m. on Monday, December 10, 2018.
