RSA 205-D Manufactured Housing Installation Standards
- Consists of 13 members, Chair and 12 additional members (205-D:2 I).
- Initial appointments staggered, 3, 2, and 1 year terms (205-D:2 II(a)-(c). Solid argument can be made that board members serving initial 1 and 2 year terms can serve one subsequent 3 year term.
- Board vacancies are covered under (205-D:2 IV).
- Board is mandated to meet every 90 days but can convene more often (205-D:2 V).
- (205-D:3) covers Board duties.
- (205-D:4) Installers have the following options: NH Standards developed by the board; Design prepared by a registered engineer or architect; or, manufactured installation instructions.
- Inspection done by local enforcement, absent local agency, State Fire
Marshal or designee (205-D:5 I). All orders issued to correct violations
require that the Board be notified (section II of 205-D:5).
- Complaints must be in writing on a form provided by the Board and must
be filed within one year from date of occupancy (205-D:6 II-VI). If Board
determines that a complaint needs further investigation-must be acted
on within 60 days (assuming investigation would be done by local authority
or Fire Marshal as applicable 205-D:6 V). Disposition of all complaints
must be by vote of the Board (205-D:6 VII).
- A license is required to install a manufactured house (205-D:7).
- License qualifications: you must be 18 years of age; have 2 years experience as an installer and complete a 6 hour class (205-D:8 1-IV).
- Licensee must be bonded in the amount of $25,000 (205-D:9).
- License application - form prescribed by the board and must be accompanied by surety bond ; a $75 license fee; provide a glossy (head to shoulder) photo of the applicant. Board may require additional information.
- License expiration and renewal (205-D:11). A 3 year license application must be notarized.
- Fees covered (205-D:12). If inspection done by local they charge fee (section III).
- Board may take no disciplinary action without a hearing (205-D:13).
- Hearings (205-D:14). Complaints shall be objectively submitted and the Board may require additional information as to trustworthiness. All complaints shall be heard and fairly considered.
- Penalty installing without license or other violations, class B misdemeanor
(205-D:15).
- Consumer Protection Act can also seek redress via this act (205-D:16.
- Before house in installed the manufacturer must secure a warranty seal from Board and attach it to the manufactured house (205-D:17).
