The Electricians’ Board met at 9:30 a.m., on Tuesday, December 14, 2004. Present were George Maihos, Chairman; Joan DeLorie, Vice Chair; Henry Szumiesz and Thomas Malley, Board members; Mark Hilbert, Senior Inspector; William Benard, Henri Dionne and Dean Sotirakopoulos, Inspectors, Robert Farley, Deputy State Fire Marshal and Pamela Olin, Administrative Assistant. A motion to approve the minutes of the November 9, 2004 meeting as amended, was made by Joan DeLorie, seconded by Henry Szumiesz and passed.
At the Attorney General’s request the Board met with Attorney Winn Arnold at 9:35 a.m., to discuss the report issued by the study committee on a proposed office of Administrative Adjudication.
Probation reports were reviewed. The Education Committee met at 9 am and reviewed requests to provide the 15 hour 2005 NEC update. Six providers were recommended to be approved by the Board. Other providers were reviewed and will be notified as to other information that needs to be included for approval. A motion was made by Thomas Malley to approve the six providers recommended by the Education Committee. The motion was seconded by George Maihos and passed.
At the Public Hearing for the changes in the administrative rules there was no comment. A motion was made by Joan DeLorie to approve the rule changes as presented. The motion was seconded by Henry Szumiesz and passed.
The Board reviewed a request by James Burke for a re-hearing. A motion was made by Thomas Malley to re-hear the case at the February 8, 2005 meeting. The motion was seconded by Henry Szumiesz and passed.
A motion was made by Thomas Malley to accept the six proposed consent agreements with Roy Ingalls, Superior Electric/John O’Donnell, Electrical Dynamics/Gary Letourneau, Arthur Desrosiers, Consolidated Electric/G.Michael Welch and Fred Charlton. Two agreements were reprimands where there were no previous violations on record and four agreements had licenses suspended for six months deferred with one year of probation reports, where there were previous violations on record. The motion was seconded by Joan DeLorie and passed.
Inspector Dionne reported visiting the North Haverhill and Sandwich fairgrounds to inspect existing installations and assist with planning of future renovations, assisting Wakefield and Hanover inspectors and working on investigations. Inspector Sotirakopoulos reported on assisting the Seabrook inspector, visiting the Cheshire fairgrounds to inspect existing installations and assist with planning of future renovations, working on investigations and consent agreements. Inspector Benard reported on investigations and inspections. Inspector Hilbert reported on the positive results of the program he put on for the Fair Association, which was well attended.
A request from the state of Vermont to share exam questions was discussed along with the related Attorney General’s opinion. A motion was made by Henry Szumiesz to approve the request as long as it was done with in the guidelines recommended by the Attorney General.
The board discussed the proposed LSR to locate the Board, to be known as the Bureau of Electrical Safety and Licensing, in the Fire Marshal’s Office and the Department of Safety. A motion was made by Thomas Malley to proceed with the LSR. The motion was seconded by Henry Szumiesz and passed.
The next meeting of the Board will be January 11, 2005 at 9:30 a.m., at the Richard M. Flynn Fire Academy, Route 106, Concord, NH. The meeting adjourned at 12:45 p.m.
