IV. Declaratory
Rulings
Parties interested in obtaining a ruling
regarding the applicability of any statute within the jurisdiction
of the board or regarding any rule or order of the PELRB may file a
declaratory ruling petition in accordance with the procedures and
requirements outlined in Pub 206.01. The petition should contain
reference to the specific statute, rule or order in question and a
clear and concise statement of the facts giving rise to the
petition. The PELRB is required to take preliminary action on such
petitions within 30 days, including whether or not the petition will
be dismissed at that stage, depending upon the information available
to the PELRB. Hearings are not required in such cases and the PELRB
may direct the involved parties to file briefs.
