ORDER

In accordance with the parties’ agreement and representations expressed at the February 4, 2009 pre-hearing conference and hearing on the respondent’s motion to dismiss:
1. The parties’ collective bargaining agreement includes arbitration which could be advisory if the award is greater than $1,000;
2. The parties agree the arbitration should be completed before there are any further proceedings at this agency and anticipate the process should be completed by June 30, 2009;
3. The District amended its request for relief to seek a stay, and not a dismissal, of this matter; and
4. There shall be no further activity in this matter unless one of the parties submits a filing seeking a hearing or other appropriate relief on or before June 30, 2009 at which time the request and any responsive filings shall be reviewed and a further order will issue. In the absence of such filings or in the event the parties notify the board that this matter has otherwise resolved it shall be dismissed.
