ORDER ON MOTION FOR REHEARING

The Board has considered the State Employees Association of NH, SEIU Local 1984, “Motion for Rehearing” and took the following actions:

1. Pursuant to RSA 541 and N.H. Admin R. Pub 205.02, it reviewed the Motion for Rehearing filed by the State Employees Association of NH, SEIU Local 1984 on January 15, 2009.

2. It examined its previous decision, PELRB Decision No. 2008-249, issued in this matter on December 5, 2008.

3. It reviewed its previous decision, PELRB Decision No. 2008-263, issued in this matter on December 30, 2008.

4. It reviewed the previous filings of the parties in this matter.

5. Upon completion of its administrative review, the Board hereby suspends the order contained within Decision No. 2008-249, and suspends its previous decision, Decision No. 2008-263, in support of the earlier Hearing Officer’s order (2008-249) pending further consideration of both as a consequence of the Supreme Court’s intervening decision on appeal of PELRB Case #S-0437-1and S-0438-1 docketed as 2008-032 and issued on January 14, 2009.

So ordered.
