ORDER

In accordance with the parties’ agreement expressed at the January 5, 2009 pre-hearing conference and hearing on the respondent’s motion to stay:

1.  The parties’ collective bargaining agreement includes non-binding arbitration which the parties anticipate will take 3-4 months to complete;

2.  The parties agree the non-binding arbitration should be completed before there are any further proceedings at this agency; and

3.   There shall be no further activity in this matter unless one of the parties files a request for hearing on or before June 30, 2009, at which time the request and any responsive filings shall be reviewed and a further order will issue.  In the absence of such filings or in the event the parties notify the board that this matter has otherwise resolved it shall be dismissed. 

So ordered.
