MODIFICATION OF CERTIFIED BARGAINING UNIT

A representation proceeding having been previously conducted by the Public Employee Labor Relations Board in accordance with RSA 273-A, and the Rules and Regulations of the Board, which resulted in the selection of an exclusive representative, and where, in accordance with PELRB Decision No. 2008-035, it has now been determined that a modification of the certified bargaining unit’s composition is appropriate under the provisions of RSA 273-A; then,

Pursuant to the authority vested in the Board by the Public Employee Labor Relations Act, IT IS HEREBY CERTIFIED that AFSCME Local 863/Rochester Public Works, is the exclusive representative of the employees of the above named public employer, in the unit as described below, for purposes of collective negotiations and settlement of grievances.

UNIT: All permanent, full-time employees of the Public Works Department and buildings and grounds. Excluding: department heads, foremen, assistant department heads, clerical, staff, seasonal and probationary employees.

Further, IT IS ORDERED that the above named public employer shall negotiate collectively with the exclusive representative named herein for wages, terms and conditions of employment for the members of the bargaining unit, as herein described, and shall recognize the right of such exclusive representative to represent employees in the settlement of grievances.
