v.

Merrimack County Nursing Home
and County of Merrimack

Respondent
Case No. M-0738-9
Decision No. 2008-023

ORDER

On February 7, 2008 the parties filed a joint motion to continue the hearing currently scheduled for March 5, 2008. After remand from the New Hampshire Supreme Court, this case was scheduled for hearing on November 7, 2007. At the parties’ request, the hearing was rescheduled, and a new hearing date of December 19, 2007 was set. At the parties’ request, this hearing date was cancelled, and status reports as to the parties’ efforts to resolve the matter were required by January 15, 2008. The parties also agreed that the only issue remaining in this case is the amount of back pay, if any, to be awarded to Ms. Foote. The parties’ status reports were filed and reflect the parties’ failure to resolve matters. Accordingly, the matter was scheduled for hearing on March 5, 2008.

The Joint Motion to Continue is granted and the March 5, 2008 hearing is rescheduled to June 11, 2008. However, no further requests to continue or reschedule the hearing based upon the parties’ efforts to resolve the matter by agreement will be allowed. Any request to continue or reschedule the June 11, 2008 hearing date shall be filed on or before February 22, 2008, shall be limited to existing scheduling conflicts, and shall state with specificity the scheduling conflict. No further status reports are required.

Both parties shall comply with the February 12, 2008 filing requirement imposed by the pre-hearing schedule contained in Decision No. 2008-017 and are allowed a 3 day extension of time for this purpose. The remaining dates are extended by 45 days.

So ordered.

February 12, 2008.
