DECISION The provisions of the parties' March 22, 2007 Stipulation, a copy of which is attached to this decision, are approved and incorporated herein. So ordered. March 26, 2007. /s/ Douglas L. Ingersoll Distribution: STATE OF NEW HAMPSHIRE AFSCME LOCAL 3438, SULLIVAN COUNTY v. SULLIVAN COUNTY NURSING HOME STIPULATION Now come the parties to the above captioned matter and agree and stipulate that the Public Employee Labor Relations Board may enter an order in this matter which provides as follows: 1. The Public Employee Labor Relations Board, with the consent of the parties, finds Sullivan County Nursing Home violated the provisions of RSA 273-A:5 (e) by refusing to bargain with AFSCM (sic) Local 3438 concerning elimination of Baylor shift scheduling; 2. The Public Employee Labor Relations Board, with the consent of the parties, orders the allegation of direct dealing filed with the Public Employee Labor Relations Board by AFSME (sic) Local 3438 against Sullivan County Nursing Home be withdrawn without prejudice; 3. The Public Employee Labor Relations Board, with the consent of the parties, orders Sullivan County to pay earned time to Kathy McNaughton; 4. The Public Employee Labor Relations Board, with the consent of the parties, orders there be no further action, by either party, for acts or omissions arising out of the elimination of Baylor shift scheduling at the Sullivan County Nursing Home; and 5. The Public Employee Labor Relations Board, with the
consent of the parties, orders Sullivan County Nursing Home to post this order
