ORDER OF DISMISSAL The undersigned hearing officer conducted a pre-hearing conference on February 16, 2007 at the PELRB in Concord. During the course of the conference the parties expressed a willingness to discuss amongst themselves resolution of this matter by agreement. Accordingly, the pre-hearing conference was suspended in order to allow the parties to engage in these discussions. The discussions concluded with the parties reaching an agreement in resolution of this matter, as expressed in the attached Stipulation of the Parties and Joint Statement. STIPULATION OF THE PARTIES The Parties hereby stipulate as follows: in lieu of proceeding to a full hearing on the merits of the Unfair Labor Practice charges and in an effort to promote a harmonious labor/management working relationship, the parties hereby agree as follows: 1. The Joint Statement (attached) of the parties shall be distributed to all Rochester Federation of Teachers (hereinafter "RFT") faculty and staff by posting on the district public folder and individual school public folders. The posting shall remain on the district public folder for at least ten (10) calendar days and on the individual school public folders for at least five (5) calendar days. 2. Donovan RMS Principal, Steven Beals Rochester School Superintendent, Mike Hopkins Attorney Charles W. Grau, Representing Steven Beals Mr. Beals has agreed to issue the following apology: Dear Rochester School Faculty & Staff: I have clearly made many mistakes in my transition to Rochester Middle School. One of these mistakes was the posting in the public folders of sensitive information brought forth by the RFT in an effort to address members' concerns. This act diminished the ability of RFT and me to work together to resolve issues of concern to faculty and staff. I want to own my actions and apologize to faculty, staff and the RFT. We will resume meeting on a regular basis to address your concerns.   Back
