Case No. M-0575-14
Decision No. 2003-031

INTERIM DECISION

The Board, meeting at its offices in Concord, New Hampshire, on March 20, 2003, took the following actions:

1. It reviewed and accepted the post hearing briefs of the parties, both filed on March 11, 2003.

2. Notwithstanding and pending the Board's disposition of this case, it noted that the ULP litigation in this matter has unduly prolonged the processing of a grievance brought by Ralph Marshall, said grievance yet to be heard at the selectmen's level of the contract grievance procedures.

3. It determined that there was no reason or cause to further delay the processing of the Marshall grievance, so-called, pending its further deliberation of the post-hearing briefs, exhibits, testimony and pleadings in this case.

4. It directed that the parties proceed, forthwith, to process the Marshall grievance, so-called, at the selectmen's level, during "business hours" not later than twenty (20) days from the date hereof and to report the results thereof to the PELRB by letter not later than seven (7) days after the conclusion and vote by the selectmen as to their disposition of said grievance.

So ordered.

Signed this 1st day of April, 2003.
