MOTION FOR REHEARING
The Board, meeting at its offices in Concord, New Hampshire on February
11, 2003, took the following actions:
1. It reviewed the City’s Motion for Rehearing filed on January 30, 2003,
as to the reasons set forth therein asserting errors on the part of the PELRB
and so as to the reasons given why the City should be entitled to a rehearing.
2. It examined the Union’s unfair labor practice (ULP) complaint filed on
August 9, 2002 and the City’s answer filed on August 23, 2002, the Union’s
objections filed on August 30, 2002, the City’s “replication” filed on September
5, 2002, the Union’s objections thereto filed September 11, 2002, and certain
other filings pleadings and/or amendments, as identified in Decision No.
2002-157, filed up to and including the date of hearing on October 24, 2002.
3. It reviewed the pre-hearing conference memoranda and orders of September
20, 2002 and October 2, 2002, respectively, as well as its decision (Decision
No. 2002-157) dated December 31, 2002.
4. It GRANTED the City’s motion for Rehearing at a date and time to be set
by the Board. At the time of that rehearing, the Board shall hear arguments
by the parties as to why the Board should or should not affirm, vacate
or modify it’s Decision No. 2002-157. Each side shall have fifteen minutes
for it’s oral argument. The Board reserves the right to request that the
parties file post-argument briefs at the conclusion of their presentations
at the rehearing and the parties may also request such a filing in accordance
with PUB 203.03
