STIPULATED AGREEMENT AND WITHDRAWAL OF COMPLAINT

NOW COME The Nashua Police Patrolmen's Association, (Complainant) and the Nashua Police Commission (Respondent), by and through its counsel in agreement and stipulate as follows:

1. The charges of unfair labor practice that are the subject matter of this complaint are hereby withdrawn, without prejudice.

2. The Nashua Police Commission, and the Nashua Police administration agree that neither it nor any of its employees or agents shall communicate directly or indirectly, either in writing or verbally, with the membership of the Nashua Police Patrolmen's Association when the subject of such communication concerns any matter relating to litigation between the parties, contract negotiations or contract grievances.

3. The Nashua Police Commission, the Nashua Police administration and the Nashua Police Patrolmen's association agree and understand that all communications, either written or oral, involving any matter relating to litigation between the parties, contract negotiations or contract grievances shall be conducted between the Chief of the Nashua Police Department and/or his designee and the Nashua Police Patrolman's Association President and/or his designee.

4. The parties agree and understand that they have reciprocal obligations to negotiate in good faith.

5. Both parties agree that they shall respond to the written requests of the other in a reasonable and timely manner.
