ORDER OF CONDITIONAL DISMISSAL For the Complainant: Robert Van Campen, Esq., AFSCME Council 93, Associate General Counsel For the Respondent: Dorothy Clarke, Esq., City of Nashua Assistant Corporation Counsel ORDER The parties convened at a re-scheduled Pre-Hearing Conference on July 28, 2001 and, after conferring, entered into stipulations which were submitted to the Public Employee Labor Relations Board, are incorporated by reference and form the basis of this ORDER. Whereas, AFSCME Council 93, Local 365, ("Union") on behalf of its members within the Public Works and Recreation departments of the City of Nashua ("City) filed a complaint of unfair labor practices against the City of Nashua on March 20, 2001 and said complaint being answered by the City on April 4, 2001; and Whereas, the Union and the City are parties to a collective bargaining agreement (CBA) for the period July 1, 1999 through June 30, 2002; and Whereas, disputes have arisen between the parties related to certain provisions of said CBA related to the existence of emergencies, overtime work, and snow removal operations; and Whereas, the parties have agreed to meet and confer on at least two occasions prior to August 15, 2001 to discuss stipulated issues related to the complaint now pending before the PELRB and to continue any further hearing on these matters before the PELRB to allow their attempt at settlement; It is therefore ordered that the pending complaint shall be administratively dismissed by the PELRB on September 1, 2001 unless a request to schedule a further hearing is filed by either party prior to that date.
