JOINT PETITION FOR DECLARATORY RULING

PRE-HEARING MEMORANDUM AND ORDER

This matter comes to the Public Employee Labor Relations Board (PELRB) by way of a jointly stipulated and submitted Petition for Declaratory Ruling filed on May 18, 2001 under the provisions of Rule PUB 206.01. The parties are represented by counsel as follows:

For the Seacoast Education Association and                 James Allmendinger, Esquire
the Seacoast Educational Support Personnel
Association, both NEA-NH affiliates

For the School Administrative Unit No. 21                      Robert A. Casassa, Esquire
School Boards

Following the submission of the Petition for Declaratory Ruling, counsel for the parties further advised the PELRB on May 29 and 30, 2001, respectively, that neither intends to call any witnesses in these proceedings and that they are both unaware of and do not intend to submit any additional documentary evidence beyond that which is attached as exhibits to the Petition. Neither side has requested a pre-hearing conference in this matter and, under the foregoing circumstances, there is no apparent need for one vis-à-vis the purposes of Rule PUB 202.01. Both parties have requested the opportunity for oral argument before the PELRB on their respective positions.

WITNESSES:

The parties have no intention of calling witnesses.

EXHIBITS AND DOCUMENTARY EVIDENCE:

The exhibits and documentary evidence are as attached to the Petition. Neither side has any intention, as of this time, to add to that which has been submitted with the pleadings. Any further documentary evidence not yet presented shall be subject to and processed in accordance with Rule PUB 203 and the sub-sections thereof.

ISSUES FOR DETERMINATION BY THE BOARD:

The issues to be addressed and determined by the PELRB are as set forth in the pleadings, particularly Items 14 and 15 thereof and the relief requested therein.

ORDER

Unless otherwise ordered as the result of the filing of any subsequent motion, oral argument before the PELRB, at its offices at 153 Manchester St. in Concord, New Hampshire, shall be scheduled for July 17, 2001, at a time to be announced, consistent with the Board's schedule on that hearing day.
