ORDER TO CONTINUE

Whereas the State Employees Association of New Hampshire, Local 1984 (Union), filed an unfair labor practice (ULP) complaint on behalf of Derry Police Supervisors on January 21, 2000, said complaint being answered by the Town of Derry (Town) filing of February 4, 2000;

Whereas the Town and the Union are parties to a collective bargaining agreement (CBA) for the period July 1, 1997 through June 30, 2000, said agreement containing a grievance procedure at Article IX thereof ending with final and binding arbitration;

Whereas, on or about October 28, 1999, the Union filed a request for the appointment of an arbitrator in a dispute which had as its basis the same facts and circumstances that are in issue in the pending ULP;

Whereas the parties made their respective presentations before an arbitrator on March 17, 2000, with thirty (30) days thereafter for the submission of post-hearing briefs and an additional thirty (30) days after those submissions for the preparation and issuance of the arbitrator's award;

Whereas the ULP in this matter was scheduled to be heard by the PELRB on March 28, 2000; and

Whereas, by filing of March 24, 2000, the parties jointly requested that this matter be held in abeyance by the PELRB until the arbitrator shall have rendered his award in this case;

IT IS ORDERED that this matter stand continued on the PELRB's docket of cases until such time as the arbitrator shall have rendered his award, that, within ten (10) days of the issuance of the arbitrator's award, the parties, or either of them, shall notify the PELRB if they seek further hearing of this ULP, and that, if neither party notifies the PELRB of its desire for further hearing of this matter within the aforesaid ten (10) days, it shall thereafter be administratively dismissed from the PELRB's docket of cases.
