ORDER TO CONTINUE

Whereas the International Chemical Workers Union Council, Local 1046C (Union) filed unfair labor practice (ULP) charges against the Merrimack County Nursing Home (County) on January 31, 2000 for breach of contract, refusal to bargain, interference and coercion under RSA 273-A:5 I (a), (b), (c), (e), (g), (h) and (i), with the County having responded to these charges on February 15, 2000;

Whereas this matter was thereafter scheduled for hearing by the PELRB on March 2, 2000, with the result that the parties sought and received a continuance therefrom after having cited availability problems concerning certain of their witnesses;

Whereas this matter was then rescheduled for hearing by the PELRB on April 4, 2000 and the parties again sought a continuance, the Union because of a conflicting commitment in another jurisdiction and a lack of staff representation and the County because it felt the intervening period of time might be used productively in an effort to resolve the disputed issues;

Whereas the PELRB, ever mindful of the provisions of RSA 273-A:6 II, is extremely reluctant to grant multiple continuances in the same case and would not be inclined to do so in this matter but for the representation that the parties will use the intervening time in a further attempt to reach a mutually satisfactory settlement of this ULP;

IT IS ORDERED that this matter be continued on the PELRB's docket of cases, to be scheduled without further continuance, in May of 2000; that the parties both reserve and keep open the dates of May 9, 10 and 11, 2000, on their respective calendars until such time as it can be determined which of these dates will be utilized as a hearing date; that, within the next thirty (30) days, the parties shall meet at least twice to discuss settlement options; and that after the second of these two meetings but no later than May 1, 2000, the parties shall report the results of those settlement discussion is to the PELRB in writing.
