MOTION FOR REHEARING

The Board, meeting at its offices in Concord, New Hampshire, on April 6, 2000, took the following actions:

1. It reviewed the Union's Motion for Rehearing and Stay filed March 6, 2000, the City's Motion for Rehearing filed March 10, 2000, the Union's objections thereto filed March 14, 2000 and the City's objections to the Union's motion as filed March 21, 2000.

2. It examined the Modification Petition filed by the City on September 27, 1999 and the Union's response filed October 12, 1999.

3. It reviewed its decision (Decision No. 2000-007) in this matter dated February 9, 2000, noting, in particular, (1) the directive that the business service officer position be removed from the bargaining unit should the incumbent continue to occupy the positions of president of the local and chief negotiator on or after March 10, 2000 and (2) that it had received no notice on or before that date that the incumbent had vacated and/or resigned from the positions in question.

4. It DENIED both the City's and the Union's Motions for Rehearing and directed that an amended unit certification be issued removing the business service officer position from the bargaining unit in accordance with Decision No. 2000-007. Any requests that the PELRB stay the removal of this position from the bargaining unit pending appeal are DENIED.

So ordered.
