MOTION FOR REHEARING

The Board, meeting at its offices in Concord, New Hampshire, on March 7, 2000, took the following actions:

1. It reviewed the Town's Motion for Rehearing filed March 6, 2000 and the Union's objections thereto also filed on March 6, 2000.

2. It examined the Petition for Certification filed by the Union on September 3, 1999, the Town's answer filed September 17, 1999, and the pre-hearing memorandum and order dated October 12, 1999 (Decision  No. 1999-104).

3. It reviewed the hearing officer's decision (Decision No. 1999-123) in this matter dated December 9, l999 and its initial review of that decision dated February 9, 2000 (Decision No. 2000-014), noting, in particular, that the firefighters in question were found by the hearing officer to be "permanent part time firefighters" essential to the operation of the fire department and not "on call" employees within the meaning of RSA 273-A:1 IX (d).

4. It DENIED the Town's Motion for Rehearing.

So ordered
