ORDER REMANDING TO CONTRACT GRIEVANCE PROCEDURE

The Board, meeting at its offices in Concord, New Hampshire, on March 7, 2000, took the following actions:

1. It reviewed the unfair labor practice (ULP) complaint in this matter filed by the Union on December 14, 1999 and the response filed by the County on December 30, 1999.

2. It convened for purposes of accepting evidence and hearing testimony offered by the parties relative to the pending ULP.

3. During the course of the proceedings, after opening arguments were offered by both parties and several witnesses had appeared on behalf of the Union, the parties requested a recess after which they returned and offered the following for the PELRB's consideration and disposition:

The parties mutually request a continuance of this case with the understanding that the County and the Union will proceed to Step III of the contract grievance procedure and, if necessary, Step IV arbitration. The Union shall withdraw the charges at such time as this matter has been resolved within the grievance procedure at Step III or Step IV.

4. The PELRB GRANTED the parties' request to remand this matter so that it might be completed under the contract grievance procedure and further directed that the parties, jointly or separately, inform the PELRB within thirty (30) days of the completion of the contract grievance process after which this matter will be administratively dismissed from the PELRB's docket of cases unless there is a motion made to reopen the ULP proceedings, for cause, during the aforesaid thirty (30) day period.
