MOTION TO REOPEN RECORD

The Board, meeting at its offices in Concord, New Hampshire, on February 22, 2000, took the following actions:

1. It reviewed the Union's request to reopen the hearing in this matter under Rule PUB 203.05 as filed on February 3, 2000 which represented that certain "documentary evidence provided by the Employer... but received after the hearing [of December 28, 1999] clearly indicate[s] that a key witness for the... Employer misrepresented facts which conflict with the Employer's own records."

2. It reviewed the County's objections to reopening the record as filed February 8, 2000.

3. It considered the seriousness of the Union's allegations and the impact on workplace justice if the testimony to be evaluated proves to be inaccurate.

4. It GRANTED the Union's Motion to Reopen Record for the limited purpose of proving the assertions made in paragraph 1 hereof and/or of clarifying the testimony claimed to have been inaccurate or misrepresented.
