MOTION TO DISMISS The Board, meeting at its offices in Concord, New Hampshire, On January 18, 2000, took the following actions: 1. It reviewed the Union's Motion to Dismiss filed on December 17, 1999 for the Town's allegedly having failed to report the status of Gary Fowler v. Town of Seabrook quarterly as required by PELRB Decision No. 1999-070 dated July 21, 1999. 2. It reviewed the Town's late filing of the requisite progress report filed December 22, 1999 and the Town's objections to the Union's Motion to Dismiss filed January 3, 2000. 3. After examining the foregoing documents, the PELRB reviewed the case file and found that the required October 1, 1999 progress report had been filed on October 1, 1999 by letter from counsel for the Town of the same date, noting, however, that that correspondence carried an erroneous case number, Case No. F-0121:11, instead of Case No. F-0121:14. 4.
