STIPULATED ORDER

The Board, meeting at its offices in Concord, New Hampshire, on March 9, 1999, took the following actions:

1. It reviewed the unfair labor practice (ULP) complaint filed by the Union on December 16, 1998 and the answer filed by the Town of December 24, 1998.

2. It convened for purposes of hearing the parties' respective
positions on the complaint and answer, but, before doing so, recessed so that the parties might engage in settlement and diversion discussions.

3. The PELRB reconvened at the conclusion of the foregoing recess and received the following stipulation from the parties:

                  a) Derry Professional Firefighters, Local 2620 voluntarily agreed 
                      to proceed to arbitration on the subject matter of the pending 
                      ULP complaint, namely, the grievance of Firefighter Kenneth
                      Pelletier. The PELRB will retain jurisdiction pending the arbitration 
                      process.

                  b) The parties agree that the Pelletier grievance will be held on June 14, 
                       1999 before Arbitrator Robert O'Brien.

                  c) The parties agree that the Pelletier grievance will be held in the 
                       morning and the Gumtow grievance (AAA #11-390-00015-99) will be 
                       heard in the afternoon on June 14, 1999.

                  d) The parties will cooperate in effectuating this agreement.

                   e) The parties agree that they will, within thirty (30) days of the 
                       arbitrator's award, notify the PELRB if they seek to have this matter 
                       placed back on the docket for a hearing. If no such notice is given 
                       within that thirty (30) day period, then this matter shall be administratively 
                       dismissed from the PELRB's docket of cases.

4. The PELRB adopts the foregoing for its order in this case.
