ORDER DISMISSING COMPLAINT

The parties, represented by counsel or their duly appointed Union representative, appeared before the undersigned hearing officer on January 21, 1999, and advised that they had reached the following agreement in order to dispose of the pending unfair labor practice complaint:

                       In consideration of the unfair labor practice filed by the City of Claremont 
                       against AFSCME, Local 1348 on behalf Claremont City Employees, the parties 
                      have agreed as follows regarding future negotiations sessions with the under-
                      standing that this agreement will .be cause for the City to withdraw the pending
                       unfair labor practice, PELRB Docket No. A-0582:1, to wit:

                                  The parties agree that the remaining negotiations sessions for 
                                  this bargaining unit will be conducted by alternating negotiating 
                                  times between hours for which bargaining unit employees who are
                                  on the negotiating team are being paid by the City and for times when 
                                  they are not being paid by the City. The alternating schedule shall be 
                                  by session and not by hours spent. The composition of the bargaining 
                                  unit team for the Union shall remain unchanged for the duration of these
                                  negotiations unless changes therein are initiated by the Union.

The foregoing was memorialized by the parties' signatures to the settlement agreement. Accordingly, the hearing officer adopts the parties' agreement as and for the Order in this case.

The ULP is DISMISSED.
