MOTION FOR REHEARING

The Board, meeting at its offices in Concord, New Hampshire, on January 23, 1997, took the following actions:

1. It reviewed the City’s Motion for Rehearing and Reconsideration filed December 30, 1996 and the Association’s Objections thereto filed January 14, 1997.

2. It reviewed the City’s Expedited Motion to Stay arbitration dated January 23, 1997 filed today.

3. It examined the City’s unfair labor practice complaint filed July 22, 1996 and the Association’s answer filed July 29, 1996, noting its first decision in this matter (Decision No. 96-096) dated October 31, 1996, denied a
Stay of Arbitration.

4. It reviewed its most recent decision (Decision No. 96-100) in this matter dated December 10, 1996, in which it found no unfair labor practice on the part of the Association and dismissed the City’s complaint.

5. It DENIED the City's Motion for Rehearing and Reconsideration. It made no ruling on the City's Expedited Motion to Stay Arbitration because it was mooted by the denial of rehearing.

So ordered.
