MOTION FOR RECONSIDERATION
The Board, meeting at its offices in Concord, New Hampshire, on
January 8, 1997, took the following actions:
1. It reviewed the State’s Motion for Reconsideration
filed on December 30, 1996 and the Association's
objections thereto filed on January 3, 1997.
2. It examined the unfair labor practice (ULP) complaint
filed by the Association on September 4, 1996 and the
answer filed by the State on October 4, 1996.
3. It reviewed its decision (Decision No. 96-109) in
this matter dated December 12, 1996, noting again the
duration of the past practice, as well as the enforceable
nature of permissive subjects of bargaining once
negotiated or elevated to the status of past practice.
4. It DENIEDthe State’s Motion for reconsideration.
So ordered.
