MOTION FOR CONTINUANCE AND ORDER TO MEDIATE The Board, meeting at its offices in Concord, New Hampshire, on January 8, 1997, took the following actions: 1. In response to the filing of an amended complaint in the above-captioned matter and in accordance with Item 4 of this Board’s order in Decision No. 96-086, it convened to hear the positions of the parties with respect to the aforesaid amended unfair labor practice (ULP) filed by the Union on November 25, 1996 and the City’s answer filed on December 10, 1996. 2. At the opening of the hearing in this matter, the parties
advised the Board that they had reached an agreement as to how to proceed in
order to resolve questions of negotiability relating to standard operating
procedures (SOP’S)of the Police Department. In involved their agreement
"to meet in order to facilitate negotiability differences, with the
assistance of a mutually acceptable mediator, Mark Grossman, (1) to assess
issues, (2) to assist the parties in determining negotiability, (3) to resolve
the merits of issues which parties are willing to settle and (4) to identify any
remaining issues as to negotiability, either with or without 3. Consistent with the foregoing agreement of the parties, the PELRB GRANTED their motion to continue this matter on its docket pending the foregoing mediation efforts, directed the agreed-to mediation and directed the filing of progress reports as agreed to by the parties.
