NORTHWOOD ZONING SECTION 5.00 OVERLAY DISTRICTS 5.05 STEEP SLOPE PROTECTION OVERLAY DISTRICT. (A) Purpose. Steeply sloped land is particularly fragile and susceptible to erosion. Because erosion and runoff problems can result from development of sloped areas, the Master Plan identifies steep slopes as requiring protection, (B) Restrictions. To accomplish the purposes of this Overlay District, the following shall apply to all areas with a slope of 25% or greater: (1) Construction of new roads through land with a slope of 25% or greater shall be prohibited. (2) Construction of structures on land with a slope of 25% or greater shall be prohibited. (3) Slopes of 25% or more shall not be used to fulfill any part the area of the minimum lot size as required per Section 3.02. (4) Prior to any disturbance of earth, suitable provisions for the prevention of erosion and for the control of runoff shall be made. Such provisions shall be maintained in full working order until the site is again stabilized with vegetation or permanent improvements, (C) Special Exceptions. A Special Exception for construction in areas with slopes of 15% or greater but less than 25% may be granted by the ZBA if the following criteria are met: (1) The impact of the clearing and development shall be the minimum necessary to accommodate the development; and (2) a suitable erosion control plan shall be implemented during construction; and (3) a suitable drainage plan shall be implemented for post development conditions.
