NEWBURY ZONING ARTICLE VIII (Steep Slopes Conservation Overlay District) 8.0 Purpose: The purpose of the Steep Slopes Conservation Overlay District is to limit the intensity of development on steep slopes in order to manage the intensity of use which can be harmoniously, appropriately and safely located on steep slopes; protect surface waters from sedimentation, turbidity, runoff of storm water and effluent from sewage disposal systems; and maintain ecological balance. 8.1 Overlay District Regulations: The special regulations of this overlay district are in addition to the regulations of either the Business or the Residential District. 8.2 Steep Slope Overlay District Boundaries: The Steep Slopes Conservation Overlay District comprises all areas with a steep slope. See definition in ARTICLE 2.65. 8.3 Development on Steep Slopes: Development is not permitted on steep slopes except as provided in Article X (Mt. Sunapee Recreation Overlay District). 8.4 Effect on Lot Size/Density Calculation: If part of a lot lies within the Steep Slopes Conservation Overlay District, only twenty (20) percent of such part shall be counted in the calculation of effective lot size. Effective lot size shall be calculated as follows: determine the area on steep slope and determine the area not on steep slope. Add twenty (20) percent of the area on steep slope to the area not on steep slope. The result must meet the requirements of Article 4.7. For example, the effective lot size is calculated as follows for a parcel containing 5 acres of steep slope and 1 acre not in steep slope: * 20% of the area in steep slope (20% of 5 ac.) = 1 acre * Area not in steep slope = +1 acre * Effective Lot Size = 2 acres 2.91 Steep Slope: An area with a measured slope of twenty-five percent (25%) or greater and an elevation change of greater than twenty feet (20'). 2.27 Development: Any man-made change to improved or unimproved real estate, including but not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation, or drilling operation.
