Other NFIP and State Regulations

  • NFIP Required Language in a Community’s Subdivision and Site Plan Review Regulations Microsoft Word Symbol - This document contains the minimum NFIP regulations that a community must adopt into their subdivision and site plan review regulations in order to participate in the NFIP.
  • Executive Order 11988 – This federal order requires federal agencies to avoid, to the extent possible, the long and short-term adverse impacts associated with the occupancy and modification of floodplains and to avoid direct and indirect support of floodplain development wherever there is a practicable alternative. Includes guidelines that address an eight-step process that agencies should carry out as part of their decision-making on projects that have potential impacts to or within the floodplain.
  • The NH State Building Code (effective April 1, 2010) references the International Building Code 2009 and International Residential Code 2009, which both include NFIP requirements. FEMA has a list of Building Code Resources that provide information concerning the flood resistant provisions of the 2009 International Code Series®, highlights of American Society of Civil Engineers (ASCE) 24-05, and the National Flood Insurance Program (NFIP) requirements.

New Hampshire Floodplain Management Related Legislation

  • NH Executive Order 96-4 Adobe Acrobat Reader Symbol- This state order requires NH state agencies to comply with a community’s floodplain development regulations.
  • RSA 674:56 Floodplain Ordinances.  Municipalities may adopt floodplain ordinances as part of their enrollment in the National Flood Insurance Program.
  • RSA 674:57 Flood Insurance Rate Maps. In a municipality which has enrolled in the National Flood Insurance Program (NFIP), special flood hazard areas shall be as designated on flood insurance rate maps issued by the Federal Emergency Management Agency. Amendments to the flood insurance rate maps shall apply to local floodplain ordinances upon their adoption by resolution of the local governing body of a municipality and shall require no further action by the local legislative body. Map amendments are subject to appeal by owners and lessees of affected real property under 44C.F.R. 67.5.
