Except under several very limited
circumstances, RSA 331-A:3 makes it unlawful for any person,
directly or indirectly, to act as a real estate broker or salesperson without a license.
Licenses in New Hampshire are issued in the form of a wall certificate and a pocket
card. Brokers must display their wall certificates prominently at their place of business,
along with the certificates of the salespersons who are associated with them.
Real estate business entities, such as corporations or partnerships, must be issued a
real estate license in New Hampshire before being allowed to practice real estate
brokerage.
No license will be issued to a broker doing business under a trade name unless the
trade name is first registered with the Secretary of States Office.
Before an applicant will be issued a broker's license he/she must successfully pass the
real estate broker examination, have worked the equivalent of either one year full-time or
2000 hours part-time as a salesperson, or prove to the Commission that he/she has
the equivalent experience required, and show proof of 60 hours of Commission approved
study, pursuant Administrative Rule Rea 301.03(h). All
principal and manager broker applicants are required to submit to the Commisssion, a
surety bond in a sum of not less than $25,000.
