New Hampshire Real Estate Commission

JURISDICTION OF THE N.H.R.E.C.

Under the New Hampshire Real Estate Practice Act (RSA 331-A), the Real Estate Commission has the authority to investigate the actions of any person engaged in the business of a real estate broker or salesperson, regardless of whether the transaction was for the person's own account, or in his/her capacity as an agent working for a client.
If the Commission finds a person guilty, at an administrative hearing, of violating the license law, it may impose any one or more of the following sanctions:

  1. Suspend, revoke or deny the renewal of a license;

  2. Levy fines up to $2,000 for each offense;

  3. Require the person to complete a relevant course in real estate
    practice; or

  4. Issue letters of reprimand.

It is important to note that all fines that are ordered by the Commission must be paid into the general fund of the state treasury. The Commission does not have the authority to order licensees to make direct restitution to buyers or sellers. In cases where money damages are sought, complaints must be brought before the civil court.
