SOME OF THE IMPORTANT DUTIES THAT ARE OWED BY REAL ESTATE LICENSEES
Licensees must:
Deal honestly and fairly with all parties;
Disclose any significant problems, of which the licensee is aware, regarding properties sold or leased;
Faithfully administer escrow funds;
Submit all written offers without undue delay;
Negotiate in the best interest of the client;
Disclose to all parties which parties they are representing; and
Disclose any personal interest in a transaction
Licensees must NOT:
Make any misrepresentation which substantially affects the value of the property;
Make any false promises of a character likely to influence, persuade, or induce;
Act for more than one party in a transaction without knowledge of all parties for whom the licensee acts;
Fail to account for or remit, within a reasonable time, any money belonging to others that comes into his/her possession;
Guarantee, authorize, or permit a person to guarantee that future profits shall result from a resale of real property;
Fail or refuse on demand to furnish copies of a document pertaining to a transaction dealing with real estate to a person whose signature is affixed to the document;
Engage in false, misleading or deceptive advertising;
Discriminate on the basis of color, religion, race, sex, national origin, familial status, disability, or violate the provisions of any state or federal anti-discrimination law.
Engage in any other conduct that constitutes improper, fraudulent or dishonest dealing, or gross negligence.
