BOARD MEETING MINUTES - December 20, 2002

 

Present:
Judith Coleman, Mary Ellen Nicholls, Paul Finn, Ron Dieter, Mike Mortimer

Not Present:--

Ron Dieter called the meeting to order at 9:10 AM

Minutes of the November 15, 2002 meeting were read Motion was made by Judith Coleman and seconded by Mary Ellen Nicholls to approve the minutes with the correction that they read: Mike Mortimer present via conference call.

I. Correspondence

A. John Brown, Ph.D. - Letter of 11/22/02

1. Letter discussed by Board
2. Send public information to Dr. Brown
3. Advise Dr. Brown the Board will notify him when the public hearing pertaining to rule making is scheduled.
4. Further reply to be sent following advice from legal counsel

B. John Brown, Ph.D. - Letter of 12/2/02

II. Bill of Rights

A. Superior Court order was distributed to Board members

B. Charles Proulx, a member of the public, distributed a Bill of Rights and additional materials, he would like the Board to consider when rewriting Mhp 502.02. The Board thanked Mr. Proulx for his time and effort.

C. The Board will mail a letter to the presidents of the professional associations and other interested parties asking for their input regarding the rewriting of the Bill of Rights rule.

III. Out of State Travel Request

A. The Board voted to expend funds from out-of-state travel to send Dr. Finn to ASPPB's mid-winter conference.

Upon the motion of Paul Finn and the second of Mary Ellen Nicholls, the Board, by roll call vote, resolved to conduct a non-public session for the purpose of discussing applications, investigations of alleged misconduct of licensees, in accordance with RSA 91-A: 3, II(c), RSA 91-A: 3, II (e), RSA 91-A: 5, IV, Lodge v. Knowlton, 118 N.H. 574 (1978), and the Board's executive and deliberative privileges. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

Upon the motion of Paul Finn and the second of Mary Ellen Nicholls, the Board by roll call vote, resolved to withhold the minutes of the preceding non-public session, with the exception of approved applications, responses to motions and disciplinary actions until they are served, from public disclosure pursuant t RSA 91-A: 3, III on the grounds that public disclosure would be likely to affect adversely the reputation of a person other than a board member and to render the proposed action ineffective. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

III. Disciplinary Matters

1. The Board approved a Settlement Agreement suspending the license of Leslie Horner-Wright, licensed clinical mental health counselor, for one year effective December 23, 2002.
