Minutes of the September 19, 2003 meeting were read Motion was made by Mike Mortimer and seconded by Paul Finn to approve the minutes as read.

I. Correspondence
Jeanne Kincaid - request for an opinion on RSA 330-A:34. Board reviewed letter and motion was made by Mike Mortimer and seconded by Mary Ellen Nicholls to respond stating it appears the consultant does not fall into the exemption categories.
II. Elections
A. Motion was made by Paul Finn and seconded by Mike Mortimer to nominate Judith Coleman, LCMHC for Chair, Ronald Dieter, Pastoral Psychotherapist for Secretary.
Motion passed.
B. Motion was made by Judith Coleman and seconded by Paul Finn to appoint Mary Ellen Nicholls Board investigator.
Motion passed.
III. Proposed Rules - Preliminary Objection
Motion was made by Paul Finn and seconded by Mary Ellen Nicholls to send response to objections to JLCAR for Mhp 302.18, Mhp 302.19 and Mhp 502.02.
Motion passed.
IV. Advisory Committee Role
A. The role of the advisory committees is:
- To help educate their discipline on how the Board works.
- Review applications if needed
- Assist psychology board member with administering the oral exam.
- Send representatives to the public session of Board meetings
- Bring information or concerns from their professional associations to the public session on the board meeting.
V. CEU'S For Investigator's
A. Given that volunteer investigators, working for the Board investigator, have ID's with expiration dates, and given the need for quality investigators, motion was made by Paul Finn and seconded by Judith Coleman for investigators to receive one hour for hour, up to 12 hours, of continuing education (including 3 in ethics) when meeting with the Board investigator.
B. Motion was made by Paul Finn and seconded by Judith Coleman that no former Board member shall be a volunteer investigator until three years have passed since the completion of their service on the Board. Past members are encouraged to seek membership on their advisory committee.
Motion passed.
VI. Data Follow-up
A. Motion was made by Judith Coleman and seconded by Mary Ellen Nicholls to allow Paul Finn to continue on his project of evaluating Board complaints and present his findings to the Board by March 2004.
Motion passed.
VII. Understanding Joint Custody
A. Motion was made by Paul Finn and seconded by Mary Ellen Nicholls to post a memo regarding joint custody on the Board's website.
Motion passed.
The Board thanked Paul Finn for his dedicated service and commitment to the Board from 1998-2003. Ms. Lynch will send a letter to St. Anselm's College Dean acknowledging the many accomplishments Dr. Finn has made to the Board.
Upon the motion of Paul Finn and the second of Judith Coleman, the Board, by roll call vote, resolved to conduct a non-public session for the purpose of discussing applications, investigations of alleged misconduct of licensees, in accordance with RSA 91-A: 3, II(c), RSA 91-A: 3, II (e), RSA 91-A: 5, IV, Lodge v. Knowlton, 118 N.H. 574 (1978), and the Board's executive and deliberative privileges. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.
Upon the motion of Paul Finn and the second of Judith Coleman, the Board by roll call vote, resolved to withhold the minutes of the preceding non-public session, with the exception of approved applications, responses to motions and disciplinary actions until they are served, from public disclosure pursuant t RSA 91-A: 3, III on the grounds that public disclosure would be likely to affect adversely the reputation of a person other than a board member and to render the proposed action ineffective. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.
