BOARD MEETING MINUTES – October 15, 2010

Present:   Sheila Renaud-Finnegan, David Braiterman, Joan Staigers Haley, Deborah Warner, Karen Griswold, David Sundell and Gail Mears. 

Not present: ---

Board meeting was called to order at 9:00 AM.

Draft minutes of the September 17, 2010 meeting were reviewed.  Motion was made by David Braiterman and seconded by Sheila Renaud-Finnegan to add language to N Mhp 503.02 (c) on page 4, change the language and move R to its own section on page 8 and remove FF which discusses the language on fines.  Motion passed.

I.   DISCIPLINARY HEARING – A public hearing was held on Docket No. 10-006 Cynthia Keenan.  See page 3 for Board action taken.

II.  ADMINISTRATIVE RULES

The Board continued review of  a letter from JLCAR Attorney Michael Morrell dated September 2, 2010 regarding the Committee’s revised objections to the Board’s preliminary objection response for Final Proposal 2008-166.  The revised objection was based on Committee staff’s annotations and public testimony.  The Board reviewed all public testimony relative to all rules addressed in Mhp 300 – 500,  JLCAR comments and the transcript of the hearing.  Motions were made on the following rules:

A.  The Board reviewed Mhp 505.04 (a)  Motion was made by JH and seconded by GM to insert the words “in accordance with Mhp 505.02” after the word misconduct. Motion passed unanimously.

B.  The Board reviewed Mhp 505.04 (b).  Motion was made by DB and seconded by DW to insert “if imposed” after the word fines.  Motion passed unanimously.

Motion was made by Sheila Renaud-Finnegan and seconded by David Braiterman to approve the Revised Objection Response and forward it, along with a cover letter, to the JLCAR.

III.  DRAFT LEGISLATION

A.  Motion was made by Sheila Renaud-Finnegan and seconded by David Braiterman to proceed to seek legislation for an impaired practitioner’s bill.  Motion passed unanimously.

IV.  NASW CONFERENCE

A.  Motion was made by David Sundell and seconded by David Braiterman to semd Sheila Renaud-Finnegan, as Board representative, to the NASW Annual meeting in New Orleans from November 11-13, 2010.  All costs are paid for by NASW.  Motion passed unanimously.

Motion passed unanimously.

Upon the motion of David Braiterman and seconded by Gail Mears, the Board, by roll call vote, resolved to conduct a non-public session for the purpose of discussing application, investigations of alleged misconduct of licensees, in accordance with RSA 91-A:3, II (c), RSA 91-A:3, II (e), RSA 91-A:5, IV, Lodge v. Knowlton, 118 N.H. 574 (1978), and the Board’s executive and deliberative privileges.  Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

Upon the motion of David Braiterman and the second of Gail Mears,  the Board by roll call vote, resolved to withhold the minutes of the preceding non-public session, with the exception of approved applications, responses to motions and disciplinary actions until they are served, from public disclosure pursuant to RSA 91-A:3, III on the grounds that public disclosure would be likely to affect adversely the reputation of a person other than a Board member and to render the proposed action ineffective.  Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

B.  Approved clinical social workers:  Jennifer Baird, Gretchen Grappone, Shelly Ledoux, Karen Lord, Gary Pinette

C.  Approved psychologists:  Deborah Wallis

D.  Approved marriage & family therapists – Lynn Bolling Wahle, Nickolas Jordan

E.  Approved pastoral psychotherapists – no applicants reviewed  this month

Gail Mears recused from Heather Crowell and Jennifer Whitcher

II.  APPROVED CANDIDATE FOR LICENSURE: SUPERVISORY AGREEMENTS

A.  Mental Health Counselors: Edward Baldwin, Jerry Bolnick, Thomas Burwell, Stephanie Huckins, Rebecca Marrs, Faithanna Thibeault.

B.  Social Workers: Amy Allen, Andrew Archer, Stephanie Bennett, Lisa Jacobs, Miriam Metz, Catherine Santo, Cassandra Spies, Margreta Weber

C.  Marriage & Family Therapists:  no agreements reviewed this month

D.  Psychologists:  Stephanie Clouse, Katerina Tolstikova, Joseph Yazvac

E.  Pastoral Psychotherapists:  no agreements reviewed this month

Gail Mears recused from Edward Baldwin, Jerry Bolnick and Stephanie Huckins

III.  DISCIPLINARY ACTIONS

A.  Cynthia Keenan –  The Board issued a Decision and Order and a Revised Decision and Order suspending Ms. Keenan’s license.

B.  Bonny Boston, LICSW – The Board approved a Settlement Agreement with Ms. Boston.  Ms. Boston is reprimanded and must obtain one year of supervision.

Meeting was adjourned at 5:10 PM
