Minutes of the September 10, 2004 meeting were read. Motion was made by Mary Ellen Nicholls and seconded by Karen Jennings to make a spelling correction on page 2 under pastoral counselor examination: fourth line down, second word should be “now” instead of not.

I. Correspondence
A. Lewis Sussman - Motion made by Karen Jennings and seconded by Mary Ellen Nicholls to send a letter referencing the ethical standard for use of testing and refer him to the psychological corporation about this matter.
B. Andrew Gersten - Motion was made by Ron Dieter and seconded by Joni Haley to email the Webmaster at ACA and inform them that they have incorrect information on their website regarding the exam used for licensure. The Board will also notify the ACA that mental health counselors can do diagnosis and this should be added to their information. Dr. Gersten will be notified, via mail, of the actions the Board took regarding this matter.
C. Eric Drogin - Motion was made by Karen Jennings and seconded by Mary Ellen Nicholls to write to Dr. Drogin thanking him for informing the Board that Dr. Salt has resigned as the liaison between NHPA and the Board and let him know the public is always welcome to the public session of Board meetings.
D. Rickey Silverman - Motion was made by Ron Dieter and seconded by Karen Jennings to have Ms. Lynch check the national data bank's definition of restricted practice. If there is no definition the Board agrees that a licensee, with a signed Settlement Agreement requiring supervision does have a restricted license. Dr. Silverman will be notified of this in writing by the Board.
II. Discussion
A. Lesson plan for investigators - Board will review this piece of information at a later date. This information came from training manual for investigators that the AG's office distributed at a training in spring of 2002.
III. Correction
A. Motion was made by Mary Ellen Nicholls and seconded by Karen Jennings to make a correction to the policy adopted in the July 16, 2004 minutes. It should read A. The Board voted to make the following policy regarding expert testimony for mental health professionals not licensed in New Hampshire-
Upon the motion of Ron Dieter and the second of Karen Jennings, the Board, by roll call vote, resolved to conduct a non-public session for the purpose of discussing applications, investigations of alleged misconduct of licensees, in accordance with RSA 91-A: 3, II(c), RSA 91-A: 3, II (e), RSA 91-A: 5, IV, Lodge v. Knowlton, 118 N.H. 574 (1978), and the Board's executive and deliberative privileges. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.
Upon the motion of Mary Ellen Nicholls and the second of Ron Dieter, the Board by roll call vote, resolved to withhold the minutes of the preceding non-public session, with the exception of approved applications, responses to motions and disciplinary actions until they are served, from public disclosure pursuant t RSA 91-A: 3, III on the grounds that public disclosure would be likely to affect adversely the reputation of a person other than a board member and to render the proposed action ineffective. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

IV. Resinstatement
A. Anthony D'Agostino - Motion was made by Mary Ellen Nicholls and seconded by Ron Dieter to reinstate Mr. D'Agostino's social work license. Mr. D'Agostino has met all of the requirements of his Settlement Agreement dated June 21, 1999.
V. Acknowledgements
The Board acknowledged and thanked Judith Coleman and Mary Ellen Nicholls for their many years of dedicated service to the Board of Mental Health Practice. Both Judith and Mary Ellen have completed their two-year term limit and will be missed. Jet Goldberg will replace Ms. Coleman as of November 1, 2004 and Sheila Renaud-Finnegan will replace Ms. Nicholls.
