BOARD MEETING MINUTES - May 20, 2005

Ron Dieter, Sheila Renaud-Finnegan, Karen Jennings, Joni Haley and Jet Goldberg

Not Present:

Ron Dieter, Board Chair, called the meeting to order at 9:05 AM

Minutes of the April 15, 2005 meeting were read. Motion was made by Sheila Renaud-Finnegan and seconded by Joni Haley to accept the minutes as read.

I. Correspondence

A. Catherine Cauthorne - Motion was made by Joni Haley and seconded by Sheila Renaud-Finnegan to send a letter to Dr. Cauthorne stating the board cannot issue a declaratory ruling on the joint custody memo on the website because it is not a statute, rule or order and explain that it was attempt provide some concrete guidelines for how joint custody issues could be approached and to raise the consciousness of practitioners and complainants who deal with this matter.

Motion passed.

B. E-harmony.com - Motion was made by Karen Jennings and seconded by Sheila Renaud-Finnegan to have Joni Haley review the voluminous materials they submitted to the Board with the question as to whether the Board would consider what they want to do on the internet as practicing marriage and family therapy.

Motion passed.

C. Motion was made by Joni Haley and seconded by Karen Jennings that the Board should set up an interview with the following persons who submitted a letter of interest in becoming an investigator: Louis Josephson, Martin Boldin and Kevin Lyness.

Motion passed.

II. Contract with Investigators

A. Motion was made by Karen Jennings and seconded by Joni Haley to approve payment for one year beginning 7/1/05 through 6/30/06 with the following investigators:

1. Vicki Anderson, Psy.D.
2. Bruce Levine, Ph.D.
3. Diane Levesque, MSW
4. Theresa Ferns, MA
5. Brad Lebo, Ph.D.
6. Carolyn Morgan, Ph.D.
7. Mo Shyne, MA

Motion passed.

III. Rule Writing

A. Work continued on draft rule writing on maximum time a social worker can have to obtain their 3000 hours of supervision, how complaint procedures will be publicized and discussed rules need to be written for criteria for choosing investigators.

IV. Licensing Database

A. Information was provided to the Board about the process for updating the Board's access database. Motion was made by Joni Haley and seconded by Karen Jennings to purchase the state e-licensing program, which will be installed by OIT beginning in January 2006. Ms. Lynch will have Vicki Tinsley of OIT email information on e-licensing to Jet Goldberg.

Motion passed

Upon the motion of Karen Jennings and the second of Jet Goldberg, the Board, by roll call vote, resolved to conduct a non-public session for the purpose of discussing applications, investigations of alleged misconduct of licensees, in accordance with RSA 91-A: 3, II(c), RSA 91-A: 3, II (e), RSA 91-A: 5, IV, Lodge v. Knowlton, 118 N.H. 574 (1978), and the Board's executive and deliberative privileges. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

Upon the motion of Joni Haley and the second of Sheila Renaud-Finnegan, the Board by roll call vote, resolved to withhold the minutes of the preceding non-public session, with the exception of approved applications, responses to motions and disciplinary actions until they are served, from public disclosure pursuant t RSA 91-A: 3, III on the grounds that public disclosure would be likely to affect adversely the reputation of a person other than a board member and to render the proposed action ineffective. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.
