Minutes of the February 28, 2003 meeting were read Motion was made by Judith Coleman and seconded by Paul Finn to approve the minutes as read.

I. Correspondence
A. Andrew Prokopis, Ph.D. - Letter informing the Board that he withdraws his request for a Declaratory Ruling on RSA 330-A:34 (a)(b).

B. Udo Rauter - Letter of 1/14/03 - Inquiry into whether or not out of state consultants need a license.
1. Letter discussed.
Motion made by Paul Finn and seconded by Mary Ellen Nicholls to inform Dr. Rauter of RSA 330-A:34 and explain unless the consultant is an employee and receives clinical supervision he/she must be licensed to practice mental health in NH.
C. Brown, John, Ph.D.

2. Review of letter Ms. Lynch sent on March 5, 2003 in response to his requests.
3. Board acknowledged his commendation to the Board regarding the posting of the Board meeting agenda on the website.
Motion made by Mary Ellen Nicholls and seconded by Judith Coleman to respond to Dr. Brown's requests for non-public information after consultation with AG's office.
D. Kristen Spath
1. Letter informing the Board of Ms. Hollenberg's resignation from the Attorney General's Office.
Motion was made by Judith Coleman and seconded by Mary Ellen Nicholls to inform Ms. Spath that the Board will be happy to continue working with the APU during this time of limited resourses.

Motion was made by Paul Finn and seconded by Mary Ellen Nicholls to accept the four names.

1. Dr. Drogin and Dr. Halikias sent the Board a letter in response to the Board's request for expert witnesses.
Motion was made by Paul Finn and seconded by Mary Ellen Nicholls to accept them as expert witnesses for possible board hearings.
G. Rorie Hollenberg, Esq.
1. The Board acknowledged Ms. Hollenberg's letter informing them of her resignation from the Attorney General's office.

II. ASPPB
A. Motion was made by Mary Ellen Nicholls and seconded by Judith Coleman to confirm phone vote of 2/10/03 nominating Paul Finn as a fellow to ASPPB.

III. Application Hearings Held

IV. Declaratory Ruling
A. The Board issued a Declaratory Ruling on the last line of RSA 330-A:2, VI requested by Steven B. Spielman, Ph.D.
Upon the motion of Paul Finn and the second of Judith Coleman, the Board, by roll call vote, resolved to conduct a non-public session for the purpose of discussing applications, investigations of alleged misconduct of licensees, in accordance with RSA 91-A: 3, II(c), RSA 91-A: 3, II (e), RSA 91-A: 5, IV, Lodge v. Knowlton, 118 N.H. 574 (1978), and the Board's executive and deliberative privileges. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.
Upon the motion of Paul Finn and the second of Judith Coleman, the Board by roll call vote, resolved to withhold the minutes of the preceding non-public session, with the exception of approved applications, responses to motions and disciplinary actions until they are served, from public disclosure pursuant t RSA 91-A: 3, III on the grounds that public disclosure would be likely to affect adversely the reputation of a person other than a board member and to render the proposed action ineffective. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.
