BOARD MEETING MINUTES - April 15, 2005

Ron Dieter, Sheila Renaud-Finnegan, Karen Jennings, Joni Haley, Julie Introcaso and Jet Goldberg

Not Present:
Mike Mortimer

Ron Dieter, Board Chair, called the meeting to order at 9:05 AM

Minutes of the March 18, 2005 meeting were read. Motion was made by Sheila Renaud-Finnegan and seconded by Karen Jennings to accept the minutes as read.

I. Correspondence

A. John P. Brown, Ph.D. - Dr. Brown's March 21, 2005 letter to the Board, Dr. Brown's March 21, 2005 letter to Attorney General Ayotte and Ms. Lynch's response to Dr. Brown's March 21, 2005 letter were reviewed by the Board and will be filed.

B. Dayl Hufford, D.Min. - Dr. Hufford informed the Board that she would no longer be available as an investigator for the Board.

II. Policies

A. A copy of the revised policies was distributed. The revisions were noted in the March 18, 2005 minutes.

III. Discussion

A. Portability - The ACA emailed the Board information about a national credentialing agency available for licensing boards, which was discussed by the Board. The consensus was the criteria is not equivalent to NH licensing requirements and New Hampshire has no interest in participating. Ms. Goldberg will inform the ACA of the Board's opinion.

B. Board Correspondence - The Board reviewed a letter sent by the Board to all licensees in March 2002 informing them of the requirement that Candidate for Licensure: Supervision Agreements must be filed at the beginning of supervision in order to be in compliance with Mhp 301.05.

C. A copy of the amended version of HB 420 was distributed and reviewed.

IV. Candidate for Licensure: Supervision Agreement

A. Motion was made by Jet Goldberg and seconded by Joni Haley to notif licensees, via bulk mailing, that relative to RSA 330-A:22 IV

"EACH SUPERVISOR'S AGREEMENT SHALL BE APPROVED BY THE LICENSING BOARD BEFORE BECOMING EFFECTIVE, AND SHALL REMAIN IN EFFECT ONLY AS LONG AS THE SUPERIVSOR ACCEPTS RESPONSIBILITY FOR THIS CANDIDATE."*

In compliance with this law post-graduate supervision hours will not begin to count towards licensure until the Candidate for Licensure:Supervision Agreement has been approved by the Board. The Board meets the third Friday of the month (except August). Agreements received at the Board office before the third Friday of the month will be put on the Board meeting agenda of the following month.

This information will take the place of the statement that was sent out in the Renewal Notice letter.

D. Motion was made by Jet Goldberg and seconded by Joni Haley that as of April 15, 2005 the Board rescinds the motion made at the March 18, 2005 meeting that Candidate Agreements will be recognized within three months of the date the supervisor signed the agreement and no further back than three months.

Upon the motion of Karen Jennings and the second of Julie Introcaso, the Board, by roll call vote, resolved to conduct a non-public session for the purpose of discussing applications, investigations of alleged misconduct of licensees, in accordance with RSA 91-A: 3, II(c), RSA 91-A: 3, II (e), RSA 91-A: 5, IV, Lodge v. Knowlton, 118 N.H. 574 (1978), and the Board's executive and deliberative privileges. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

Upon the motion of Karen Jennings and the second of Joni Haley, the Board by roll call vote, resolved to withhold the minutes of the preceding non-public session, with the exception of approved applications, responses to motions and disciplinary actions until they are served, from public disclosure pursuant t RSA 91-A: 3, III on the grounds that public disclosure would be likely to affect adversely the reputation of a person other than a board member and to render the proposed action ineffective. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.
