Tom Boulter called the meeting to order at 8:00 AM

Draft minutes of the February 20, 2009 meeting was reviewed.  Motion was made by Gail Mears and seconded by Joni Haley to approve the minutes as read.

I.  Correspondence

A.  William Gunn & Sheila Gardner, NHPA – The Board reviewed correspondence from NHPA dated February 16, 2009 and March 16, 2009 regarding various matters related to the proposed rules and the rule writing process.  Motion was made by Kay Sternenberg and seconded by Gail Mears to respond to NHPA in writing.  Motion passed.

II.  Rule Writing Update

A.  Tom Boulter and Ms. Lynch consulted with Mike Morrell, Attorney for Legislative Services, to discuss the staff comments made to the Board’s initial proposals of Mhp 100, Mhp 200 and Mhp 300-500.

B.  A rules subcommittee meeting is scheduled for April 7, 2009 from 1 – 3 PM  at the Board office.  This is a non-public meeting, however, the public is welcome to come and listen.

III.  Travel Requests

A.  Sheila Renaud-Finnegan – The Board’s waiver request to Governor and Council, to allow Ms. Renaud-Finnegan to attend the ASWB meeting in Quebec, was denied.

B.  Ms. Lynch will attend ASPPB’s mid-year meeting in Boston.  The entire meeting is being paid for by ASPPB and there will be no cost to the Board.

Upon the motion of David Sundell and seconded by David Braiterman, the Board, by roll call vote, resolved to conduct a non-public session for the purpose of discussing application, investigations of alleged misconduct of licensees, in accordance with RSA 91-A:3, II (c), RSA 91-A:3, II (e), RSA 91-A:5, IV, Lodge v. Knowlton, 118 N.H. 574 (1978), and the Board’s executive and deliberative privileges.  Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

Upon the motion of David Sundell and the second of David Braiterman, the Board by roll call vote, resolved to withhold the minutes of the preceding non-public session, with the exception of approved applications, responses to motions and disciplinary actions until they are served, from public disclosure pursuant to RSA 91-A:3, III on the grounds that public disclosure would be likely to affect adversely the reputation of a person other than a Board member and to render the proposed action ineffective.  Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.
