BOARD MEETING MINUTES - January 17, 2003

Ron Dieter called the meeting to order at 9:20 AM

Minutes of the December 20, 2002 meeting were read Motion was made by Judith Coleman and seconded by Mike Mortimer to approve the minutes as read.

I. Correspondence

A. John Brown, Ph.D. - Letter of 12/17/02

1. Letter discussed by Board

Motion made by Mike Mortimer and seconded by Judith Coleman to deny Dr. Brown's request that the Board formally waive attorney-client privilege to legal advice given by Anne Edwards.

Motion passed.

B. Sue Walsh - Letter of 1/9/03

1. Letter discussed.

Motion made by Mary Ellen Nicholls and seconded by Judith Coleman to comply with Ms. Walsh's request to remove her 12/19/02 letter from the agenda.

Motion passed.

C. NHPA - Letter of 12/30/02

1. Letter discussed.

Motion made by Mary Ellen Nicholls and seconded by Judith Coleman to discuss advisory committees with legal counsel.

Motion passed.

II. Reciprocity Agreement

1. Board reviewed a reciprocity agreement with ASPPB for licensed psychologists.

Motion was made by Judith Coleman and seconded by Mary Ellen Nicholls to discuss this agreement with legal counsel and NHPA.

Motion passed.

III. Legislative Service Request

1. The Board noted there are two LSR's on the legislative web site relative to the Board of Mental Health Practice:

2003-H-0757-R and 2003-S-1182-R

Upon the motion of Mike Mortimer and the second of Mary Ellen Nicholls, the Board, by roll call vote, resolved to conduct a non-public session for the purpose of discussing applications, investigations of alleged misconduct of licensees, in accordance with RSA 91-A: 3, II(c), RSA 91-A: 3, II (e), RSA 91-A: 5, IV, Lodge v. Knowlton, 118 N.H. 574 (1978), and the Board's executive and deliberative privileges. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

Upon the motion of Mike Mortimer and the second of Mary Ellen Nicholls, the Board by roll call vote, resolved to withhold the minutes of the preceding non-public session, with the exception of approved applications, responses to motions and disciplinary actions until they are served, from public disclosure pursuant t RSA 91-A: 3, III on the grounds that public disclosure would be likely to affect adversely the reputation of a person other than a board member and to render the proposed action ineffective. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

5. Approved pastoral psychotherapists - no applicants for licensure

1. The Board approved a Settlement Agreement reprimanding Katherine Giffin, LCMHC.
