BOARD MEETING MINUTES – June 15, 2012

Present: Alan Goodman, LCMHC, Shawn Hassell, LMFT, Deborah Warner, LP, David Sundell, LPP, Kim Spencer, LICSW, Honorable Joseph P. Nadeau, Public Member and Jane Power Kilcoyne, Ed.D. Public Member. Jane Kilcoyne, Ed.D. was only present for vote on the draft minutes of the June 8, 2012 meeting.

Not present: Kim Spencer, LICSW and Kathleen Skinner Shulman, Ed.D., Public Member

Board meeting was called to order at 9:00 AM.

Draft minutes of the May 18, 2012 meeting were reviewed by the Board. Motion was made by Alan Goodman and seconded by Deborah Warner to approve the minutes with the following corrections: remove double vote recorded on the William Lax matter on page 2 and remove the word “final” on the Corrective Supervision manual matter on page 3. Motion passed.

Draft minutes of the June 8, 2012 public meeting were reviewed by the Board. Motion was made by Jane Kilcoyne and seconded by Alan Goodman to approve the minutes as presented. Motion passed.

I. PETITION FOR DECLARATORY RULING

A. William Lax, Ph.D. – The Board reviewed a Petition for Declaratory Ruling as to the definition of “in residence” as stated in Mhp 302.03 (b) & (c). Motion was made by David Sundell and seconded by Alan Goodman to have Deborah Warner draft a response ruling for Board consideration at its July 20, 2012 meeting.

II. LEGISLATION UPDATE

A. SB 343-FN – establishing an independent board of psychologists- passed/adopted by the Senate with amendment. Senator Bradley concurred with House amendment 2012-2192h. Nothing further scheduled.

B. HB 1508 – relative to procedures of the board of mental health practice – House concurred with the Senate with amendment 2012-1990s. Nothing further scheduled.

III. DISCUSSION

A. Corrective Supervision Manual - Deborah Warner reported that the supervision manual is in process and it will be presented for Board review at an upcoming meeting.

B. Question to be added to application for licensure – Motion was made by Alan Goodman and seconded by Deborah Warner to add the following question to the license application: Have you ever been previously licensed with this Board? (If yes, please provide a written description of the type of work you have been doing since your license expired, whether in NH or elsewhere.) Question 21: change “your” to “any”.

IV. RULES STUDY UPDATE

A. Dr. Goodman will prepare a list of concerns the Board has with the current rules that it might want to consider changing.

Upon the motion of Deborah Warner and seconded by Shawn Hassell, the Board, by roll call vote, resolved to conduct a non-public session for the purpose of discussing applications, investigations of alleged misconduct of licensees, final disciplinary action and other adjudicatory decisions, in accordance with RSA 91-A:3, II (c), RSA 91-A:3, II (e), RSA 91-A:5, IV, Lodge v. Knowlton, 118 N.H. 574 (1978), RSA 330-A:29, V, and the Board’s executive and deliberative privileges. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

Upon the motion of Alan Goodman and the second of David Sundell, the Board by roll call vote, resolved to withhold the minutes of the preceding non-public session, with the exception of approved applications, responses to motions and disciplinary actions until they are served, and CEU’s for Professional Conduct Investigators from public disclosure pursuant to RSA 91-A:3, III on the grounds that public disclosure would be likely to affect adversely the reputation of a person other than a Board member and to render the proposed action ineffective. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

B. Approved clinical social workers: no applications approved this month

C. Approved psychologists: no applications approved this month

E. Approved pastoral psychotherapists – no applicants reviewed this month

II. APPROVED CANDIDATE FOR LICENSURE: SUPERVISORY AGREEMENTS

A. Mental Health Counselors: Shauna Clark, Sandra Acosta, Renee Lesley, Rachel Kowalski, Deborah Carney, Elizabeth Byron and Kaleen Potter.

B. Social Workers: no agreements for review this month

C. Marriage & Family Therapists: Joni O’Brien and Stephanie Higgs

D. Psychologists: Josh Kingsbury and Teresa Reeves

E. Pastoral Psychotherapists: no agreements for review this month.

III. ADJUDICATORY PROCEEDINGS

A. Spiegler, Jeffrey, MA – Docket No. 12-002 – The Board approved a Preliminary Agreement for Practice Restrictions.

Meeting was adjourned at 2:15 PM
