BOARD MEETING MINUTES – December 14, 2012

Present: Alan Goodman, Ph.D., LCMHC, Shawn Hassell, MS, LMFT, David Sundell, D.Min., LPP, Kim Spencer, MSW, LICSW, Deborah Warner, Ph.D., LP, Honorable Joseph P. Nadeau, Public Member, Jane Power Kilcoyne, Ed.D. Public Member, Kathleen Skinner Shulman, Ed.D., public member.

Board meeting was called to order at 9:00 AM.

Upon the motion of Jane Kilcoyne and seconded by Alan Goodman, the Board, by roll call vote, resolved to conduct a non-public session for the purpose of discussing applications, investigations of alleged misconduct of licensees, final disciplinary action and other adjudicatory decisions, in accordance with RSA 91-A:3, II (c), RSA 91-A:3, II (e), RSA 91-A:5, IV, Lodge v. Knowlton, 118 N.H. 574 (1978), RSA 330-A:29, V, and the Board’s executive and deliberative privileges. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

Upon the motion of Jane Kilcoyne and the second of Alan Goodman, the Board by roll call vote, resolved to withhold the minutes of the preceding non-public session, with the exception of approved applications, responses to motions and disciplinary actions until they are served, and CEU’s for Professional Conduct Investigators from public disclosure pursuant to RSA 91-A:3, III on the grounds that public disclosure would be likely to affect adversely the reputation of a person other than a Board member and to render the proposed action ineffective. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

I. APPLICATIONS APPROVED FOR LICENSURE

A. Approved mental health counselors: Sarah Morin, James Wood, Jill Fimbel, Siobhan Lopez and Lori Magoon.

B. Approved clinical social workers: Rachel Jones, Sara Baker, Jennifer Decato, David Marshall, Jennifer Martin and Linda Demo.

C.Approved psychologists: Claire Scigliano, Colleen Carney and Amanda Goza.

D.Approved marriage & family therapists – Derek Hagey and Amanda Pooler

E. Approved pastoral psychotherapists – no applicants reviewed this month

II. APPROVED CANDIDATE FOR LICENSURE: SUPERVISORY AGREEMENTS

A. Mental Health Counselors: Lisa Witham, Lauren Faretra and Glenn Mott

B. Social Workers: Nora Yasumura, Judy McAuley, Stephanie Charron, Melissa Gregg, Shanna Braden and Cody Lounsbury.

C. Marriage & Family Therapists: Jeanette Dustin, Sarah Russell, Paige Gauthier, Candice Alizio and Catherine Lee-Keeler.

D. Psychologists: Doris Velker Hauret and Sara Chung.

E. Pastoral Psychotherapists: no agreements for review this month

Public session resumed.

Draft minutes of the November 16, 2012 meeting were reviewed by the Board. Motion was made by David Sundell and seconded by Alan Goodman to approve the minutes with the following corrections: delete “and Ed.D.” from members present and edit the vote on the review of the 10/19/2012 minutes to read: Not voting: DW instead of recused.

I. LEGISLATION UPDATE

A. HB 1508 – HB 1508 becomes law January 1, 2013. Motion was made by Jane Kilcoyne and seconded by Alan Goodman to postpone discussing the immediate application of this law until the Board has additional time dedicated to this and has read all information thoroughly. The Board will contact legal counsel regarding any items specific to HB 1508 that need to be addressed immediately.

B. HB 1508 – Motion was made by Alan Goodman and seconded by Jane Kilcoyne to take all steps necessary to comply with HB 1508 effective January 1, 2013.

II. CORRESPONDENCE – no correspondence this month

III. DISCUSSION

A. Corrective Supervision Manual – an updated draft manual was distributed as well as suggestions for recommended additions to Board rules. The Board will review the manual at a scheduled Board meeting in 2013.

B. Title change for Order of Formal Investigation – tabled until January 18, 2013

C. Encumbered vs. Restriction – Definitions were discussed. Motion was made by Deborah Warner and seconded by Alan Goodman to accept the following definitions as they relate to Settlement Agreements not yet completed.

Encumbered - allows unlimited scope of practice but with imposition of
conditions

Restriction – limits scope of practice in some way

D. Record Retention schedule – The Board reviewed a record retention schedule. Motion was by Kim Spencer and seconded by Alan Goodman to take all necessary steps to be in compliance with New Hampshire law when scanning and archiving records. The Board will notify the Office of the Attorney General of its plan to ensure compliance with Archives and Records Management.

III. RULES STUDY UPDATE

A. Work continues on possible rule changes. Work continues on suggested rule changes. Information regarding Mhp 301.02 was reviewed.

IV. ELECTIONS

A. Board Chair – Motion was made by Alan Goodman and seconded by Jane Kilcoyne to nominate Joseph Nadeau for Board Chair. No other nominations were made and the vote to elect Joseph Nadeau for the next year was unanimous.

B. Board Secretary – Motion was made by Jane Kilcoyne and seconded by Kathleen Skinner Shulman to nominate Kim Spencer for Board Secretary with the authority to act as Board chair in Joseph Nadeau’s absence. No other nominations were made and the vote to elect Kim Spencer was unanimous.

C. Deborah Warner, Ph.D. – Dr.Warner will continue her role as supervisor of the supervisors group.

D. David Sundell, D. Min. will continue his role as the Board Investigator.

V. SCANNING POLICY

In anticipation of Board consolidation in the fall of 2013 and the move to the Philbrook building, Board staff will scan the application booklet, exam score and supervision confirmation forms of independent clinical social workers, pastoral psychotherapists, clinical mental health counselors and marriage and family therapists with an expired license onto an external harddrive. The psychology applications will be given to the Board of Psychology on July 1, 2013.
