BOARD MEETING MINUTES – July 20, 2012

Present: Alan Goodman, LCMHC, Shawn Hassell, LMFT, Deborah Warner, LP, David Sundell, LPP, Kim Spencer, LICSW, Honorable Joseph P. Nadeau, Public Member, Jane Power Kilcoyne, Ed.D. Public Member and Kathleen Skinner Shulman, Ed.D., Public Member.

Not present: ---

Board meeting was called to order at 9:00 AM.

A public hearing was held on the matter of Fred Bates, LCMHC – Docket 12-001

Upon the motion of Deborah Warner and seconded by Kim Spencer, the Board, by roll call vote, resolved to conduct a non-public session for the purpose of discussing disciplinary sanctions of specific licensees, in accordance with RSA 91-A:3, II (c), RSA 91-A:3, II (e), RSA 91-A:5, IV, Lodge v. Knowlton, 118 N.H. 574 (1978), RSA 330-A:29, V, and the Board’s executive and deliberative privileges. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

Upon the motion of Kim Spencer and the second of Jane Kilcoyne, the Board by roll call vote, resolved to withhold the minutes of the preceding non-public session, with the exception of approved applications, responses to motions and disciplinary actions until they are served, and CEU’s for Professional Conduct Investigators from public disclosure pursuant to RSA 91-A:3, III on the grounds that public disclosure would be likely to affect adversely the reputation of a person other than a Board member and to render the proposed action ineffective. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

Draft minutes of the June 15, 2012 meeting were reviewed by the Board. Motion was made by David Sundell and seconded by Shawn Hassell to approve the minutes with the following correction: change the date of the next scheduled Board meeting from June 15, 2012 to July 20, 2012.

I. PETITION FOR DECLARATORY RULING

A. William Lax, Ph.D. – The Board reviewed a Petition for Declaratory Ruling in which Dr. Lax asked the specific question: Does the Union Psy.D. Program meet the eligibility criteria of Mhp 302.03 (b) & (c)? Motion was made by Deborah Warner and seconded by Kim Spencer to issue a declaratory ruling in accordance with RSA 541-A:1, V. The Board ruled as follows:

1. Students currently in the program do not meet the criteria of the full year in residency required in Mhp 302.03. Please reference Mhp 302.02

2. Students beginning next year will be one course short of the full year in residency, but might submit a request for waiver if their additional in-residence courses fall outside of that year. This current Board cannot make an obligation upon a future Board with respect to its decision on such a request.

II. LEGISLATION UPDATE

A. HB 1508 – relative to procedures of the Board of Mental Health Practice –
Deborah Warner presented a flowchart for section 9 of HB 1508. This was for informational purposes only.

B. SB 343 – establishing an independent Board of Psychologists – signed by the Governor. Chaptered law 0233. No further update.

III. DISCUSSION

A. Corrective Supervision Manual –Deborah Warner presented a draft supervision manual for Board review. This manual is intended to serve as a guide to supervisors and licensees under corrective supervision. A revised manual will be reviewed at the September 21, 2012 Board meeting.

B. Criminal background check - the Board discussed changing the application process to require all applicants and candidates for licensure submit a criminal background check. Rules will have to be written to address this process.

IV. RULES STUDY UPDATE

A. Motion was made by David Sundell and seconded by Shawn Hassell to have Board members review specific sections of Mhp 200-500. Each Board member will email suggested changes to Peggy Lynch by September 4, 2012. Ms. Lynch will make the changes on a draft document which will be available at the September 21, 2012 meeting.

Knowlton, 118 N.H. 574 (1978), RSA 330-A:29, V, and the Board’s executive and deliberative privileges. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

C. Approved psychologists: Lauren Cook and Brian Taracena

D. Approved marriage & family therapists –Susan Hamann

E. Approved pastoral psychotherapists – no applicants reviewed this month

II. APPROVED CANDIDATE FOR LICENSURE: SUPERVISORY AGREEMENTS

A. Mental Health Counselors: Cynthia Connell, Liane Kerbyson, Brian Harvey, Amanda Gautreaux, Lisa Rhys, Valerie Vigue, Barry Lewis and Jenny Vanderbilt.

B. Social Workers: Jennifer Brooks, Debra Arena, Julie Benjamin, Donald Piciask, Lindsay Herdman, Shawn Young, Jason Forbes and Jonathan Hutchings.

C. Marriage & Family Therapists: Sarah Minella

D. Psychologists: Elyse Corbett

E. Pastoral Psychotherapists: no agreements for review this month

III. SETTLEMENT AGREEMENT

A. Paul D. Lassins, LICSW – The Board approved a Settlement Agreement with Mr. Paul D. Lassins, effective 7/24/2012. This agreement is a public document and can be viewed at www.nh.licenses.nh.gov.
