BOARD MEETING MINUTES – June 21, 2013
Present: Alan Goodman, Ph.D., LCMHC, Shawn Hassell, MS, LMFT, Kim Spencer, MSW, LICSW, Deborah Warner, Ph.D., LP, Honorable Joseph P. Nadeau, Public Member, Jane Power Kilcoyne, Ed.D. and Kathleen Skinner Shulman, Ed.D., Public Member.
Not present: David Sundell, D.Min., LPP
Board meeting was called to order at 9:00 AM.
Draft minutes of the May 17, 2013 meeting were reviewed by the Board. Motion was made by Alan Goodman and seconded by Shawn Hassell to approve the minutes with the following correction: page 4, last paragraph, remove the “d” at the end of sentence one. Motion passed.

I. INTERPRETATION OF ONE ACADEMIC YEAR
A. Motion was made by Alan Goodman and seconded by Shawn Hassell to approve the following interpretation of one academic year:
The Board interprets one academic year as referenced in Mhp 302.03 (b), Mhp 302.13 (b), Mhp 302.16 (c) and Mhp 302.22 (g) as a minimum of 12 graduate credits of face to face, on-site interaction over 2 or more semesters.

B. Motion was made by Deborah Warner and seconded by Shawn Hassell not to include Mhp 302.03 (b), which references psychology requirements, in the Board’s interpretation of one academic year referenced in I A.
Vote: For: DW, SH, KS

A. Jennifer Bruns – The Board reviewed a letter from Ms. Bruns asking the Board for clarification of the in residence requirement for licensed clinical mental health counselors in NH. Motion was made by Alan Goodman and seconded by Kim Spencer to send Ms. Bruns a copy of the Board’s interpretation of one academic year and explain that under the current interpretation of Mhp 302.16 (c) it appears her program will not meet the requirements. If she has further documentation she would like the Board to consider it must be submitted at the time of application for licensure. Motion passed unanimously.
B. Sisemore, Heather – The Board reviewed a letter from Ms. Sisemore in asking the Board for clarification on specific requirements of her program at Capella and NH licensing requirements. Motion was made by Jane Kilcoyne and seconded by Kim Spencer to send Ms. Sisemore a copy of the Board’s interpretation of one academic year and explain that under the current interpretation of Mhp 302.16 (c)(d) it appears her program will not meet the requirements. If she has further documentation she would like the Board to consider it must be submitted at the time of application for licensure. Motion passed unanimously.
C. Long, Ryan, MA, LCMHC – The Board reviewed a letter from Mr. Long asking the Board whether or not an internship at a school would meet the requirement of Mhp 302.04(k)(2)k. Motion was made by Deborah Warner and seconded by Shawn Hassell to inform Mr. Long that a school setting will not provide a clinical experience and a single intern does not meet the criteria of the rules. Motion passed unanimously.
D.Owens, Trenton – The Board reviewed a letter from Mr. Owens asking the Board for clarification of NH Administrative Rule Mhp 302.03 (b) which requires one academic year of full-time graduate study be completed in residence. Motion was made by Kim Spencer and seconded by Jane Kilcoyne to forward Mr. Owen’s letter to the Board of Psychology after July 1, 2013. Motion passed unanimously.
III. LEGISLATION UPDATE
A. HB 234 – relative to occupational and professional board and commissions procedures concerning military service and occupational experience or training. As of May 3, 2013 this bill passed the house with amendment and is currently in the Senate
IV. RESOLUTION (Kim Spencer - acting Chair for this agenda item)
A. Motion was made by Joseph Nadeau and seconded by Kathleen Skinner Shulman to present the following Resolution to be presented to Elyse Alkalay’s family, the Office of the Attorney General and the Governor. Motion passed unanimously.
The members of the New Hampshire Board Of Mental Health Practice, with pride and sadness, express our appreciation for the outstanding service of Elyse Alkalay to the Board. We acknowledge, as well, her remarkable contribution to the practice of mental health, and to the people of New Hampshire.
Elyse was a person of sound judgment, keen intellect and high character. These qualities she brought to every meeting and every issue.
Elyse faced Board challenges and answered difficult questions with dignity and true professionalism. Her advice was always wise and scholarly.
We are all fortunate to have known and worked with Elyse. She truly set the standard by which all future Board attorneys will be judged and to which they should all aspire.
Elyse Alkalay was, in short, the kind of person we all expect a first rate lawyer to be.
To her family and friends we express our profound sadness at her loss.
The Board Administrator is directed to make this resolution part of the permanent record of our proceedings and to cause a copy, suitably framed, to be presented to Elyse’s family.

V. DISCUSSION AND REVIEW
A. Rulemaking process - Rulemaking process to be discussed
B. Correspondence for review by the Board – Motion was made by Jane Power Kilcoyne and seconded by Deborah Warner to approve the following policy. If someone wants written correspondence reviewed by the Board it must be received at the Board office two weeks prior to the meeting. Exceptions can be made by the Chair. Motion passed unanimously
C. Public participation in a Board meeting – Motion was made by Alan Goodman and seconded by Kim Spencer to approve the following policy. If someone wishes to address the Board during public session of its meeting, a written request must be received at the Board office six (6) weeks prior to the meeting they wish to attend. Motion passed unanimously.
Upon the motion of Alan Goodman and seconded by Kim Spencer, the Board, by roll call vote, resolved to conduct a non-public session for the purpose of discussing applications, investigations of alleged misconduct of licensees, final disciplinary action and other adjudicatory decisions, in accordance with RSA 91-A:3, II (c), RSA 91-A:3, II (e), RSA 91-A:5, IV, Lodge v. Knowlton, 118 N.H. 574 (1978), RSA 330-A:29, V, and the Board’s executive and deliberative privileges. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

Upon the motion of Deborah Warner and the second of Kim Spencer, the Board by roll call vote, resolved to withhold the minutes of the preceding non-public session, with the exception of approved applications, responses to motions and disciplinary actions until they are served, and CEU’s for Professional Conduct Investigators from public disclosure pursuant to RSA 91-A:3, III on the grounds that public disclosure would be likely to affect adversely the reputation of a person other than a Board member and to render the proposed action ineffective. Each member recorded his or her vote on the motion, which passed by the unanimous vote of all members present.

C. Approved psychologist: Theodore Austin
D. Approved marriage & family therapists – no applicants approved this month.
E. Approved pastoral psychotherapists – no applicants reviewed this month
II. APPROVED CANDIDATE FOR LICENSURE: SUPERVISORY AGREEMENTS
A. Mental Health Counselors: Corey Hill, Caitlin Moore, Diane Desharnais, Lauren Faretra, Angela Jones, Barbara Nesbitt, John Korvey and Elizabeth Achorn.
B. Social Workers: Shanna Frye, Monique Barber, Joan D’Angelo, Jessica Brazeau, Megan Currie and Kelly Aschbrenner.
C. Marriage & Family Therapists: Alexis Roberson and Stephanie Higgs
D. Psychologists: no agreements for review this month
E. Pastoral Psychotherapists: no agreements for review this month.
III. LCMHC license #1000 issued
A. The Board approved LCMHC #1000. The license will be presented to Alexis Ozimek, MA by Governor Hassan on Friday, July 12, 2013.
